Download: Requesting above Guideline Child Support in California

Don't think an existing child support order or agreement is sufficient to cover your child's needs? You can request an above-guideline amount. This template should be used in conjunction with a Request for Order to modify (change) an existing child support or spousal support order or agreement.

When to Use: You have asked the Judge to order child support that is above the amount calculated using the state-mandated child support calculator.

Why: There are specific circumstances under which the Judge can order more child support than the calculation mandates. You will want to provide the Judge with the law that supports your request. Presentation of the law is done through a Memo of Law that is then filed with the Court.

This template will guide you through the preparation of a Memo of Law for the above guideline child support.
